Abstract:
Chapter 14 approaches disability and age as prohibited grounds of discrimination. The two grounds of discrimination have in common that they relate to situations in which any person can find themselves. Consequently, in both of these categories the distinction between 'us' and 'them' is shifting and fluid. The sections that make up this chapter examine the way in which the EU and the Council of Europe law addresses discrimination based on disability or age. Reference is also made to the treatment that these two categories of discrimination have received in the legal orders of the Anglo-American legal tradition, and, in particular, in the law of the United States.
