Abstract:
Chapter 10 presents three representative models regulating prohibited grounds of discrimination that operate at the national, international and supranational level. The objects of examination are: the closed model, consisting of an exhaustive list of prohibited grounds of discrimination established by the legislature; the intermediate model, implemented through a statutory equality clause which is concertized by the judge through the prohibition of individual grounds of discrimination; and finally, the open model, comprising a non-exhaustive list of prohibited grounds of discrimination established by the legislature and supplemented by the judge
