Abstract:
The concept of direct discrimination refers to all those cases in which one person is treated less favourably than another for reasons related to their "legally protected" characteristics. It follows from the above definition that the prohibition of direct discrimination seeks to serve the principle of formal equality, which requires the equal treatment of the like. The implementation of this prohibition, therefore, encounters the obstacles and limitations imposed by the aforementioned principle. In the 6th chapter, we will identify these limitations by examining the structure of direct discrimination (2) and the ways in which its justification is achieved (3). In the 1st section of the 6th chapter, we will see how direct discrimination is defined by European anti-discrimination texts, namely the European Union Directives regulating this issue and the European Convention on Human Rights (1).
