Description:
Abstract:
Chapter 2 presents the various forms of the principle of equality and their more specific manifestations. It begins by considering formal or legal equality and its various dimensions: equality before the law and equality within the law, on the one hand, and numerical and proportional equality, on the other hand. After highlighting the shortcomings of proportional equality, substantive equality and its more specific versions, namely equality of opportunity, equality of outcome and equality as an expression of human dignity are examined. The three versions of the principle of human dignity and their contribution to the interpretation of the principles of equality and non-discrimination are also analysed. The chapter concludes with a discussion of the various purposes of substantive equality.
