Abstract: |
This book serves as the main textbook for the course ‘’Feminism and Law’’ (previously entitled as ‘’ The issue of Gender…’’) taught for several years at the Athens Law School (N.K.U.A.). The aim of the textbook is to introduce young jurists to a dynamic and evolving critical theory in the field of law and feminist studies, i.e. feminist legal theory. The introductory chapter presents the historical background and the specific components of this theory, as well as its theoretical foundations placed in a process of constant renegotiation. Given that feminist legal theory is necessarily linked to feminist theory in general, the book will focus largely on the so-called three feminist waves and their respective legal perspectives according to the chronological order of their appearance: egalitarian feminism, difference feminism (in its three versions: radical, French and cultural feminism) and postmodern feminism. Seeking to highlight each one’s complete normative argumentation, the basic structure of the book provides that the chapters devoted to theory are followed by chapters of practice, to examine the corresponding legal claims and transformations, alongside with the impact that feminist waves have on the field of law.
