Abstract:
This chapter is devoted to several key aspects of international law. It starts by pointing out that the concept of international law was more limited prior to 1945, being exclusively inter-state law. The history of international law is presented from its first appearance during the Renaissance until today, including the following items: natural law, legal positivism, the various challenges regarding international law and how they were finally overcome in today’s post-1945 international law based on the UN Charter and other fundamental legal and normative documents (hard law and soft law). The chapter concluded with the sources of international law, namely conventional law (treaty law), international customs, general principles of law and the resolutions of the UN and other intergovernmental organizations that are legally binding or authoritative.
