Abstract:
Chapter 11 presents the criteria used by national and international courts to select the prohibited grounds of discrimination. These criteria are: the immutability of the identity characteristic to be referred to as a prohibited ground of discrimination, the lack of political power of the group bearing the characteristic in question, the affront to human dignity caused by the use of the characteristic in question as a ground of discrimination, and finally, the existence of a history of oppression against the group bearing the characteristic.
